Chaudhry’s lawyer files for strikeout application

The lawyer of Rajendra Chaudhry has today filed a strikeout application with the Court Registry.

Chaudhry was found guilty of one count of contempt of court earlier this year.

His lawyer today filed the application on the grounds that the Fiji court does not have jurisdiction over Chaudhry in Auckland and he cannot be brought to justice.

He adds that Chaudhry is not a practitioner in Fiji and the Independent Legal Service Commission can only discipline those who have a practicing certificate.

In court today, the State said that it sternly opposes the application.

The matter has been adjourned to the 15th of November 2019.

Meanwhile, a hearing date for the appeals case of New Zealand lawyer Rajendra Chaudhry will be set on October 14th.

Chaudhry was ordered to pay a fine of $50,000 and sentenced to 15 months imprisonment after found guilty.

The court heard that the amount has been reduced to $5000 and the fine has been cleared off.

In May this year, Chaudhry was convicted for making defamatory comments on Facebook against the former Chief Justice Anthony Gates, Judge Justice Yohan Liyanage, and the Fijian Judiciary as a whole.

He made the comments between September and October last year.
