Man wins compensation case, WAF ordered to pay $38,844 in damages

The High court has ordered the Water Authority to pay a 44-year-old man more than $38,000 in compensation.

The man received injuries after falling into an uncovered waterlogged manhole chamber in Naitonitoni, Navua.

Rakesh Kumar took the matter to court on the basis that his injury was caused by the Authority’s breach of statutory duty.

The incident happened on 10th January 2013 while he was playing soccer at the Naitonitoni ground.

Kumar who lost his job as a recorder at Navua hospital following the injury is currently employed as a youth administrator at the Ministry of Youth and Sports.

The court was informed that Kumar is no longer able to walk long distances.

According to the doctor who gave evidence, Kumar’s condition will worsen as he ages and it is highly likely that he will develop arthritis.

The High court has ordered that Kumar be paid $38, 844 in damages.
