Man convicted of defrauding after appeal

*The Lautoka High court has convicted a man of obtaining more than $90,000 by false pretense following an appeal by the State. *

Dayendra Prasad was charged with one count of obtaining money by false pretense but was acquitted of the charge by the Magistrates court last year.

The court heard that between 2008 and 2009 with an intention to defraud, he obtained $93,286 cash from Fiji National Provident Fund, the account of a Suresh Prasad for his own use.

The state appealed the acquittal.

High court Judge Justice Sunil Sharma said the learned Magistrate erred and or misdirected himself on the law and fact.

Justice Sharma allowed the appeal against the acquittal.

The order of acquittal by the Magistrates court was set aside and found Prasad guilty.

Prasad has been remanded in custody for sentencing.
