Judge Temo to sum up rape case

Suva High Court Judge, Justice Salesi Temo will tomorrow sum up trial involving 31-year-old Ilatia Nalawa’s alleged rape of a nine year old girl in Nakasi in July last year.

The State and Defense Counsels made their closing submissions today.

In his closing submission, Ilaitia Nalawa’s lawyer Panapasa Tawake told the assessors that his client is innocent.

Tawake says the victim has not been able to identify the iTaukei man whom she said was wearing a mask on the day of the alleged offence and he did not have a mole and a tattoo as stated by the victim in court.

He told the assessors that the alibi of witnesses highlighted in court that they were with Nalawa in his uncle’s farm having tea on the day and time of the alleged offence..

Tawake says the police have charged the wrong person and they must find him not guilty.

Meanwhile, State Counsel, Seini Puamau says that Nalawa confessed to the offence in his statement to Police, adding that the police found him to be the lead to the alleged offence.

She says Nalawa was interviewed and cooperated with police and he answered all the 180 questions that were put to him.

The State is relying on the victim’s evidence and the mother’s evidence.

The summing up will be delivered at 2.15pm tomorrow.
