High Court Judge Justice Riyaz Hamza has overturned the unanimous opinion of three assessors, finding a 39-year-old uncle guilty of rape.

Charged with one count of rape, it is alleged that the 39-year-old man raped his 19-year-old niece in the eastern division in October, 2016.

The attack is alleged to have happened when the girl visited the village where the accused resides.

According to the court transcripts, the uncle asked the victim to come over to his house to do his laundry, where he’s alleged to have forced himself onto the girl in his bathroom.

While delivering his judgement, Judge Hamza told that the prosecution had proved its case beyond reasonable doubt.

Adding that they presented truthful and reliable evidence satisfying all elements of the offence of rape.

The man who was charged with one count of rape is the victim’s maternal uncle.

He is scheduled to be sentenced later this week.
