Judge finds Devi guilty

The Suva High Court has found Marianne Premila Devi guilty of murder.

Judge Justice Salesi Temo while delivering his judgement this afternoon said he concurred with the opinion of the three assessors who unanimously found Devi guilty.

Devi is convicted of one count of murder.

The forty-one-year old on November 17th in 2016, with intent to cause the death of her de-facto partner, Bal Krishna Naidu, poured kerosene on him and set him on fire at their home in Sakoca, Suva.

Justice Temo said after reviewing the evidence, he found the prosecution’s version credible.

The Judge says he accepts the declaration made by Naidu through the two state witnesses, Samuela Viaviaturaga and Dr Amit Sewak during trial, that Devi had set him alight.

Justice Temo also highlighted the acceptance of Devi’s statements during her caution interview and conversation with the doctor at CWM hospital, where she admitted she had committed the crime.

The Judge said he rejects the suggestion by Devi that setting her partner alight was unintentional and that it was only an accident.

Justice Temo said that Devi was not a credible witness and on numerous occasions while on trial she was evasive while giving evidence.

The defence counsel in mitigation, said Devi was a first time offender and that the incident was not pre-meditated.

The Judge will deliver his sentence tomorrow.
