Island Chill manufacturer to sell

The manufacturer of Island Chill bottled water had been ordered to sell the company assets to recover a debt it owes.

The winding up order comes after a petition was filed against the company Dayal’s (Fiji) Artesian Waters Ltd for failure to honor a debt payment of $293, 435. 68.

The petition was filed by the company that supplies PET resin to Dayal’s for the manufacture of water bottles.

The Suva High Court noted that the company was only paid $20,000 and no other payments was made thereafter for the supply of resin which started in November 2007.

Dayal’s (Fiji) Artesian Waters Limited claimed the materials supplied were of poor quality therefore affecting the taste of the water.

However – the High Court has found that no lab analysis was done and there was no evidence to suggest the poor quality of materials as the cause for the alleged poor water quality.

The petitioner has also been granted $1,250 for the cost of the action.
