HRADC files constitutional redress of Josua Lalauvaki

The Human Rights and Anti-Discrimination Commission has filed a Constitutional Redress application on behalf of Josua Lalauvaki, who was allegedly murdered by two police officers two months ago.

Three declarations sought by the HRADC in the Notice of Motion include a declaration that Lalauvaki’s Constitutional Right to Life under Article 8 of the Constitution were violated and breached.

Secondly, a declaration that Lalauvaki’s Constitutional Right to Freedom from Cruel and Degrading Treatment under Article 11 of the Constitution were violated and breached.

Thirdly, a declaration that Lalauvaki’s Constitutional Rights of Arrested and Detained Persons under Article 13 of the Constitution were violated and breached.

Meanwhile, police officers Kelepi Kolinisau and Selema Tikoenaburevere are alleged to have murdered Lalauvaki following an assault outside a nightclub in Suva on September 2nd.

Lalauvaki died at the Colonial War Memorial Hospital last month as a result from injuries allegedly sustained in the assault.
