High Court Judge to sum up murder case

The Suva High court Judge Justice Vincent Perera will sum up the case tomorrow in relation to former pilot Imshaad Izraar Ali who allegedly murdered his de-facto partner in Samabula Suva nine years ago.

This is after the defence and the prosecution closed their case yesterday.

The lawyer for Imshaad Izraar Ali – while addressing the assessors – said his client was subjected to torture, abuse and assault during three days in police custody.

It’s alleged that on November 3rd, 2009, Ali murdered his de-facto partner Rajeshni Sharma at her residence on Rewa Street in Samabula.

The prosecution is alleging that on 1st November from 9 to 11pm Ali and Sharma had an argument, and then Ali struck her with an iron rod.

It’s also alleged that Ali strangled Sharma with a kettle cord. However Ali has denied all these allegations.

His lawyer said that his client’s caution interview was fabricated and there were inconsistencies in the evidence given by the state witnesses.

He also said that his client’s rights were breached.

The prosecution in its closing submission said that Ali admitted killing Sharma in his caution interview.

He said that Ali killed Sharma on 1st November 2009 during an argument between 9pm and 11pm.

After the summing up the assessors will retire behind closed doors to deliberate on an opinion.
