Foana Nemani case called today

June 12, 2012 5:06 am

An application for Trial in Absentia was filed by FICAC today due to the continued absence of Foana Nemani from Court.

The application was made at the Suva High Court as the former Deputy General Manager of the Fiji National Provident Fund has been absent from trial for over two years.

The Court heard that the matter had been adjourned on several occasions and it is not known whether she would return or not.

FICAC Prosecutor, Rashmi Aslam stated that further adjournment would not resolve this issue.

He also informed the Court that there was no provision in the Fiji Criminal Procedures Decree concerning a Trial in Absentia except for section 171 mentioning a hearing in the absence of the defendant in a Magistrates Court.
