Defence cross examines witness in sedition case

A hearing in the voir dire application in a sedition case continued today in the Suva Magistrates Court.

Defence Counsel, Barbara Malimali who is representing SODELPA Member of Parliament, Mosese Bulitavu today cross examined ASP Mesake Waqa, a witness who went to Labasa to arrest her client.

Malimali pointed out to the witness that Bulitavu, was not given the right to remain silent, which was not in the caution interview.

Waqa replied that he told Bulitavu that he was not obliged to say anything, during the interview.

Malimali also highlighted that on the first day of the interview, procedures were not followed and the interview was not signed.

Waqa who was the interviewing officer agreed that it was not signed.

Bulitavu was arrested at the Labasa Investiment office on the 5th of October, 2011.

The application is challenging the circumstances under which a caution interview was obtained when the two accused, businessman, Jagath Karunaratne andSODELPA Member of Parliament, Mosese Bulitavu were questioned by Police.

The hearing will continue next week.
