DPP told to check exhibit for evidence

Suva High Court Judge, Justice Salesi Temo has ordered the prosecution to check the exhibit for drugs kept as evidence in the case against the accused person Maciu Libu.

The 52-year-old is charged with unlawful cultivation of illicit drugs.

It is alleged he had in possession 57.5kg and 239.4g of drugs believed to be marijuana on separate occasions in 2016 at his home in Navosa.

In court today, the state said this is a strong case for them as the drugs were found inside the accused home.

The defence says the drugs need to be checked if it is still in the exhibit since this case arose from 13 arrests during raids and some were dismissed.

The DPP says the drugs are in the exhibit but they will check again while the defence says they are now sorting out voir dire challenge.

Justice Salesi Temo told both clients if there were to be any destruction of drugs in the exhibit, the order has to come from the High Court.

Bail has been extended for Libu and a pre-trial is set for the 31st of this month.
