Court overturns unanimous not guilty verdict of three assessors

The Suva High Court has overturned the unanimous not guilty verdict of three assessors in an aggravated burglary and theft case.

Delivering his judgment, Judge Justice Salesi Temo said Luke Seniceva and Viliame Motokainava are guilty of one count each of aggravated robbery and theft.

The two had broken into the Tamavua Primary School in July 2016 and stolen assorted items worth $9, 178.

Justice Temo says he disagrees with the decision of the assessors as the two accused in their caution interview had agreed to trespass and charges were laid accordingly.

They will be sentenced this afternoon.
