Alleged rape victim fit to testify

The defence lawyer in the rape trial of a former proposed National Federation Party candidate has proposed that the complainant undergo an evaluation.

He pointed out in court she had attended proceedings for three consecutive days in the same outfit.

The High Court Justice also raised concern about the wellbeing of the complainant who suffers from asthma.

The court discussed the complainant’s medication with her taking ventolin and painkillers, and after conferring with a medical attendant it was agreed the 54-year-old woman could continue to testify.

It is alleged she was raped by her 66-year-old brother-in-law in Nasinu on the 28th of June last year.

It is alleged he approached her and asked if he could spend the night at her house because he was too tired after a wedding to go back home.

He allegedly started knocking on her bedroom door in the middle of the night and then forced his way into the room and allegedly raped the woman.

The trial continues in the Suva High Court.
