Court dismisses Fiji Water's case against YPCL

A claim filed by Natural Waters of Viti Limited for an injunction requiring the Yaqara Pastoral Company Limited to execute a restrictive covenant in a shared land agreement between the two has been dismissed.

The case was heard in the Suva High Court today.

On the 15 July, 1995, Yaqara and Nature’s Best entered into an agreement over the land with a caveat included, giving each the first right of refusal over the purchase of the other party’s interest in the property.

It was agreed this would come into affect if Yaqara wished to dispose of its land to any other party than Natural Waters or if it receives an offer or agrees to a price.

While the lease between the two companies remains in effect, the caveat on sale has been dismissed.

Meanwhile the Natural Waters of Viti Limited is to pay costs in the sum of $5,500 to the Yaqara Pastoral Company Limited and also five hundred dollars to the second defendant.
