Assessors find Vakarisi not guilty of arson

Three assessors in the trial of 29-year-old Jone Vakarisi who is alleged to have set fire to a house in Kinoya, in 2004 has found him not guilty of one count of arson.

However two assessors found Vakarisi guilty of one count of assault causing actual bodily harm and one assessor found him not guilty.

Justice Vincent Perera will deliver his judgement on Monday at 11:45am.

This afternoon, Justice Perera in his summing up told the assessors to see if the first witness who was the complainant was telling the truth or lying about the identification of the accused.

The defense counsel yesterday informed the High court that his client was wrongfully identified and accused of a crime.

He also said the first state witness had lied to court when he said that he knew Vakarisi since 2004, because during that time, his client was in still secondary school.

The defense stated that the prosecution has failed to prove that Vakarisi had participated in the alleged incident.

However, the prosecution says there is evidence against Vakarisi that he had allegedly committed the crime.
