27-year-old serving prisoner seeks constitutional redress

A 27-year-old man currently serving a life sentence for murder is seeking a constitutional redress against the Attorney General’s Office, the Correction Commissioner and the Police Commissioner.

Salesi Balekivuya who exhausted all the process of appeal is claiming several breaches and violation of his rights during his arrest in 2010.

He is also claiming that the evidence against him was unlawfully obtained.

Balekivuya was convicted of one count of murder, one count of damaging property and one count of attempted robbery.

The court heard that on 4th May 2010, Balekivuya assaulted Krishneel Singh in Shalimar Street, Nabua which resulted in his death.

Balekivuya was sentenced to mandatory life imprisonment with a non-parole period of 20 years.

He informed the court that he was 19-years-old when he started serving his sentence.

He is now seeking several orders including a re-trial and immediate release.

High court Judge Justice Daniel Goundar said that the application seems like abuse of process.

Lawyers representing the AG’s office informed the court that they will be filing a strike out application in this matter.

The matter has been adjourned to 1st March 2019.
